					<description>to address what #31 said ... the liability insurance policies for the pilots (if they were personal, which i seriously doubt, would not be eligible for immediate family) .. life insurance policies for the pilots would be eligible for their families and i just hope they had them .. now, the liability of the pilots (if there is any) would serve to negate any recovery .. put it this way ... if the tires are to blame, then everyone can sue the tire manufacturer (dj am etc etc) but there might be a 'per occurrence' limit which would basically mean all the plaintiffs would be dividing up the 'pie' so to speak ... this is the insurance dividing up .. now, DJ AM can sue the pilots for their negligence (say there is negligence)  ... but the pilots estate/family wouldn't sue the pilots for negligence (you can't sue 'yourself') at least as far as the insurance goes. so, as far as that goes, DJ AM likely isn't taking away insurance  money from the families of the pilots however say everyong is suing the tire manufacturer ... then everyone likely has to take a piece of 'pie'.</description>

Unless he is filing in a state where direct actions against insurance companies are allowed (Louisiana is one) then yes, the lawsuit names the actual insureds (ie. the pilots) and technically then 'yes' he is suing the deceased pilots. The insurance companies for the pilots (i presume the insurance is actually through the airlines liability policies etc) likely step in to 'protect' /'defend'/ 'stand in front of' their insured, however there could be coverage issues and the insurance would not cover the loss (don't know all the details etc. to state thoughts). Unless the pilots had their own specific Gen Liab policies for their work, their personal policies would not cover something like this as it was work related. Anyway, DJ AM might be twisting the truth a little bit.</description>
